Terms and Conditions
ChrisXCreative — Chris Edwards, sole trader
Kidderminster, Worcestershire, United Kingdom
Last updated: 27 September 2026
These Terms and Conditions (“Terms”) apply to all services provided by Chris Edwards, trading as ChrisXCreative (“we”, “us”, “our”). By accepting a quotation, paying a deposit or using our services, you (“the Client”) agree to these Terms. If anything in a signed quotation conflicts with these Terms, the quotation takes priority for that project.
1. Definitions
- Client — the person or organisation commissioning or using our services.
- Services — any service we provide, as listed in section 2.
- Deliverables — websites, designs, photographs, video and other work we supply.
- Quotation — the written quote, proposal or email agreement for a piece of work.
- Consumer — a Client acting for purposes wholly or mainly outside their trade, business or profession.
2. Our Services
- Website design and WordPress development
- Ecommerce websites
- Web hosting, email hosting and domain registration
- WordPress maintenance and support
- Graphic design and branding
- Drone photography and video
Every project is delivered under a written Quotation. Published prices (for example “from £499”) are starting points; the final price is set in your Quotation once scope and requirements are agreed.
3. Quotations and Project Process
- Quotations are valid for 30 days unless stated otherwise.
- A 50% deposit is required before work begins. The deposit secures your place in our schedule and covers planning and preparation. Subject to your rights as a Consumer (section 4), it is non-refundable once work has started.
- Timelines are set out in your Quotation and depend on content, feedback and payments arriving on time. If any of these are delayed, the timeline moves accordingly.
- You must supply text, logos, images and other materials promptly and in a usable format.
- If a project is paused by the Client for more than 60 days, we may invoice for work completed to date and reschedule the remainder.
4. Your Rights as a Consumer
If you are a Consumer and you agreed to our services at a distance (online, by phone or by email), you have a 14-day cancellation period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you ask us to start work within those 14 days and then cancel, you will pay for the work carried out up to the point you tell us you are cancelling. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.
5. Revisions and Scope
- The number of revision rounds included is set out in your Quotation.
- Work beyond the agreed scope — new pages, features, extra revision rounds or redesigns — will be quoted and agreed in writing before we start it.
- Additional pages start from £30 each. Current prices for extras are shown on our pricing page.
6. Payment Terms
- Invoices are due within 7 days of issue unless agreed otherwise in writing.
- All prices are in GBP. We will tell you in your Quotation if VAT applies.
- Final files, website launch or admin access may be withheld until payment is received in full.
- For business Clients, we may charge statutory interest and compensation on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.
- We may suspend ongoing services (including hosting and maintenance) if an invoice is more than 14 days overdue, after giving you written notice.
6.1 Online Payments
Invoices can be paid securely through our client portal. Card payments are processed by Stripe; we never see or store your full card details. Payments are subject to Stripe’s Terms of Service and Privacy Policy. If you have a problem with a payment, email hello@chrisxcreative.co.uk. Refunds, where due, are made to the original payment method.
7. Hosting and Domains
- The first year of hosting is included with every new website we build. After that, hosting is charged at the rate on our pricing page (currently £20 per month), billed in advance.
- Hosting includes a free SSL certificate, business email hosting, daily backups and support.
- Our hosting runs on UK servers powered by 100% renewable energy, independently verified by The Green Web Foundation.
- We monitor uptime around the clock and aim for high availability, but we cannot guarantee uninterrupted service. Planned maintenance will be kept to a minimum and, where possible, notified in advance.
- Domains are registered in the Client’s name wherever the registry allows. Domain renewal is charged annually (currently £25 per year). You are responsible for renewing domains on time if you manage them yourself.
- Hosting must be used in line with our Fair Usage Policy. We may suspend a site immediately if it is compromised, used to send spam or distribute malware, or puts other customers at risk.
- If you move away, we will provide a full backup of your website and reasonable help to transfer it, provided your account is paid up to date.
8. WordPress Maintenance and Support
- Maintenance is charged at the rate on our pricing page (currently £30 per month), billed in advance.
- It includes WordPress core, theme and plugin updates; security monitoring and malware checks; daily backups; uptime monitoring; and small text, image and design changes.
- New pages, new features, forms and redesigns are outside maintenance and will be quoted separately.
- We can maintain sites we did not build. Before taking one on, we may need to carry out a one-off health check and update, which will be quoted first.
9. Drone Services
- All flights are carried out in line with UK law and Civil Aviation Authority (CAA) rules, as a CAA-registered operator (Operator ID GBR-OP-LX6MJB9J4XGY) with £5 million public liability insurance.
- Flights may be rescheduled at no extra cost because of weather, airspace restrictions or safety concerns. The pilot’s decision on whether it is safe to fly is final.
- You must tell us about access arrangements, landowner permissions and any known restrictions in advance. A cancellation fee may apply if a flight cannot go ahead because this information was not provided.
Usage Rights
- Once paid for in full, you may use drone photographs and video for the purposes agreed in your Quotation (for example your website, social media and marketing).
- Footage may not be resold or licensed to third parties without our written permission.
- We retain copyright in drone footage unless otherwise agreed in writing.
10. Your Content and Responsibilities
- You confirm that everything you supply (text, images, logos, video) is yours to use and does not infringe anyone else’s rights.
- You are responsible for the accuracy and legality of your website’s content.
- You must keep your passwords and access details secure and use our services lawfully.
- If your website collects personal data (for example through contact forms, shops or donations), you are the data controller for that data and responsible for your own privacy notice and lawful basis.
11. Intellectual Property
- Once we have received payment in full, ownership of the bespoke design and content we create for you passes to you (drone footage is covered in section 9).
- Themes, plugins, fonts, stock images and other third-party assets remain subject to their own licences.
- We may show completed work in our portfolio and case studies, and include a small “Website by ChrisXCreative” credit link in your site footer, unless you ask us not to.
12. Data Protection
- We handle personal data in line with UK GDPR and the Data Protection Act 2018, as set out in our Privacy Statement.
- Where we host or maintain your website, we act as a data processor for personal data held on it, and process it only on your documented instructions. We keep it confidential, protect it with appropriate security measures, use only sub-processors bound by equivalent obligations (such as our UK hosting provider and Stripe), help you respond to data subject requests and personal data breaches, and delete or return it when our services end.
- We will tell you without undue delay if we become aware of a personal data breach affecting data we process for you.
13. Third-Party Services
Websites rely on third-party services such as hosting providers, plugins, payment gateways and analytics tools. We choose these carefully, but we are not responsible for their availability, changes to their terms or pricing, or faults in them outside our control.
14. Limitation of Liability
- We take reasonable care to keep websites secure, backed up and available, including daily backups and security monitoring.
- We are not liable for indirect or consequential losses, such as loss of profit, revenue, business or goodwill.
- Our total liability to you for any claim is limited to the amount you paid us for the service concerned in the 12 months before the claim.
- Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded by law, including your statutory rights as a Consumer.
15. Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including extreme weather, pandemics, power or internet outages, or failures of third-party providers. We will let you know as soon as possible and resume as soon as we can.
16. Ending Services
- Hosting and maintenance can be cancelled by either side with 30 days’ written notice.
- If an account remains unpaid 30 days after suspension, we may close it and delete the associated data. We will warn you in writing before doing so.
- When services end, we will provide a copy of your website and data on request, provided your account is paid up to date.
17. Complaints
If you are unhappy with any part of our service, please email hello@chrisxcreative.co.uk. We will acknowledge your complaint within 2 working days and aim to resolve it within 14 days.
18. Governing Law
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a Consumer living elsewhere in the UK, you may also bring proceedings in your local courts.
19. Changes to These Terms
We may update these Terms from time to time. The current version is always available at chrisxcreative.co.uk/terms-and-conditions. Changes do not affect work already agreed under an earlier version.
